Terms of Service

Scanary (the "app") is operated by Doanything AI (ABN 15 938 400 909), a business based in Australia ("we", "us", "our"). These Terms of Service ("Terms") form a binding agreement between you and Doanything AI.

Agreement

By downloading, installing or using the app, you acknowledge that you have read, understood and agree to be bound by these Terms. If you do not agree, you must not use the app.

What the App Does

Scanary lets you scan food labels and receive general guidance about ingredients that may be relevant during pregnancy or for young children. The app can flag items such as alcohol, caffeine, raw or undercooked ingredients, unpasteurised products, high-mercury fish, allergens, choking hazards, added sugar, sodium and similar food-safety concerns.

Not Medical Advice

Scanary provides general educational information only. It is not medical, nutritional, allergy, paediatric, obstetric or other professional advice. It does not diagnose, treat, prevent or manage any disease, pregnancy complication, allergy or health condition. You should consult your doctor, midwife, OB/GYN, paediatrician, dietitian or other qualified professional about your personal circumstances.

Do not use the app for emergencies or urgent health decisions. If you or your child may have had an allergic reaction, food poisoning, poisoning, choking event or other urgent medical issue, contact emergency services or a qualified medical professional immediately.

Eligibility

You must be at least the age required by the app's App Store age rating in your jurisdiction and old enough to form a binding contract under the law applicable to you. If you are a minor, you must have the consent of a parent or legal guardian to use the app.

Your Responsibilities

AI Accuracy and Label Limitations

Scanary uses OCR and AI systems to read labels and generate summaries. Results can be incomplete, incorrect or out of date. Accuracy depends on photo quality, visible packaging, language, lighting, label formatting, model performance and the information you provide. Ingredients, formulations and safety guidance can change. Always verify important information against the product label and appropriate professional or official guidance.

Subscriptions and Free Scans

Abuse, Abnormal Activity and Access Limits

We may monitor for abuse, fraud and abnormal activity. If we detect or reasonably suspect automated use, scripted use, device sharing, attempts to bypass rate limits or subscription checks, excessive usage, service interference, unlawful content or other misuse, we may suspend or terminate access, revoke usage, refuse future service and/or take other reasonable steps. Where permitted by law, you will not be entitled to a refund for access restricted due to misuse.

Service Availability

The app depends on network connectivity, third-party infrastructure, AI services, Apple App Store services and RevenueCat. We do not guarantee uninterrupted or error-free service. Features may be changed, limited, suspended or discontinued from time to time.

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded, restricted or modified.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have the problem rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

Limitation of Liability

Subject to the Australian Consumer Law section above and any other non-excludable rights you may have at law:

To the maximum extent permitted by law, and subject always to the Australian Consumer Law section above, you indemnify and hold harmless Doanything AI, its directors, officers, employees and contractors from and against any claims, liabilities, losses, damages, costs and expenses arising out of or in connection with:

Intellectual Property

The app, including its design, branding, code and content, is the intellectual property of Doanything AI or its licensors. These Terms grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for lawful personal purposes. All other rights are reserved.

Apple App Store - Additional Terms

The following terms apply to your use of the app on Apple devices and prevail over any conflicting provisions in these Terms to the extent required by Apple:

Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected in the "Last updated" date above. Continued use of the app after changes constitutes acceptance of the updated Terms.

Governing Law and Jurisdiction

These Terms are governed by the laws of Victoria, Australia. You and Doanything AI submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them. Nothing in this section prevents a consumer from relying on mandatory protections available under the law of their place of residence.
